Terms and Conditions of Use and Sale (T&Cs) of DROONE – ReCLASS

1. Purpose

These General Terms of Use and Sale (“T&Cs”) set out the rules for accessing and using the website dronereclass.com (the “Website”) published by DROONE, as well as the conditions applicable to online sales of the ReCLASS solution and other products offered.


Placing any order on the Site constitutes full and unconditional acceptance of these T&Cs.

3. Products and services offered

The Website offers:

  • The ReCLASS solution, consisting of a physical kit shipped to the customer to install, combined with a regulatory compliance service;
  • Other physical products related to the drone sector (accessories, equipment).


The ReCLASS solution includes:

  • sending of a physical components ;
  • the customer’s obligation to provide DROONE with : 
    1. proof of correct installation,
    2. a sworn statement confirming no hardware or software modification of the drone and that manufacturer updates have previously been carried out,
    3. the drone’s serial number, and
    4. a photo of the original class label on the drone;


following validation by DROONE, issuance of a certificate of conformity enabling registration of the drone in the new class.

DROONE may request any additional documents needed for verification.


In the event of non-compliance, the certificate may be refused; the customer will be informed of the reasons.


4. Order process

Steps: (1) add to basket, (2) confirm order, (3) enter billing/shipping details, (4) payment via Stripe, (5) confirmation e-mail.


The order becomes firm and final once payment has been validated.


5. Prices and payment

Prices are shown in euros, including VAT unless stated otherwise.


Payment is by bank card only via Stripe (secure transaction in accordance with Stripe's terms).


Invoices are sent by e-mail after the order is validated and are retained in accordance with legal obligations.


6. Delivery and fulfilment

6.1 ReCLASS

The upgrade pack is sent by post/courier. The certificate of conformity is issued after receipt and validation of the documents (proof of installation, sworn statement, serial number, photo of the original label).


Missing or insufficient supporting documents may delay issuance; DROONE may refuse the certificate in the event of non-compliance.


6.2 Other products – carriers, lead times, regions

Carriers :

France : Colissimo (standard), Chronopost (express D+1 before 1 p.m. for any order placed before 2 p.m.);

EASA countries outside France: DHL.


Indicative lead times:

Colissimo France: 3 to 7 working days;

Chronopost France: D+1 before 1 p.m. (order before 10 a.m.);

DHL (EASA countries): 3 to 7 working days.


Shipping costs: 

vary according to the chosen method; rates are displayed before basket validation.


Delivery area:

EU Member States and other countries applying EASA regulations, as published by the European Union Aviation Safety Agency (EASA).


Lead times are indicative; DROONE cannot be held liable for delays attributable to the carrier or a force majeure event.


6.3 Ackowledgement of your parcel and Claims

On parcel's aknowledgement, the customer must check its integrity and make any required claim to the carrier’s delivery note (and confirm these to the carrier within 3 working days). Any anomaly not reported within this period may limit the carrier’s liability.


7. Right of withdrawal and returns (consumers only, excluding professionals)

Consumers got 14 days from parcel's aknowledgement to exercise their right of withdrawal.


Exceptions:

ReCLASS: once the certificate of conformity has been issued, no withdrawal is possible (service linked to regulatory compliance).

Returned products must be complete, unused and in their original packaging.

Return shipping costs: payable by the customer.

Refund issued after receipt and inspection of the return.

(For business customers, no statutory right of withdrawal applies)


8. Statutory warranties

DROONE applies the statutory warranties:

– Conformity warranty (French Consumer Code L.217-3 to L.217-14): 2 years;

– Hidden defects warranty (French Civil Code arts. 1641 et seq.).

9. After-sales service

10. Specific B2B terms (professionals)

For any order placed by a professional:


Late payment: 

Late-payment interest at the statutory rate plus a fixed €40 recovery charge (French Commercial Code L.441-10).


Retention of title:

Products remain the property of DROONE until payment in full (French Commercial Code arts. 2367 et seq.). Risk passes upon handover to the carrier.


Jurisdiction:

See art. 14 below (Courts of Montpellier).


11. Personal data and cookies

Processing of personal data is described in the Privacy Policy.


Use of cookies is detailed in the [Cookie Policy].


12. Intellectual property

The Site, its content and its elements (texts, images, graphics, logos, trade marks, domain names, layout/structure) are the property of DROONE or used with permission.


The ReCLASS and Drone ReCLASS trade marks are registered and used by DROONE.


Any unauthorised reproduction, representation, distribution, adaptation or exploitation is prohibited.


13. Liability – force majeure

DROONE uses reasonable means to ensure access to and proper functioning of the Site. Access may be suspended (maintenance, upgrades, incident).


DROONE is not liable for indirect loss (loss of data, loss of opportunity, business loss), nor for delays/unavailability due to the carrier, networks or a force majeure event.


These limitations apply without prejudice to consumers’ mandatory rights.


14. Consumer mediation & jurisdiction

Consumers may refer the matter to the mediator after a prior written approach to DROONE has failed to resolve the issue.


Jurisdiction:

Disputes with professionals (B2B): exclusive jurisdiction of the courts of Montpellier;

Disputes with consumers (B2C): jurisdiction determined by protective rules (court of the consumer’s domicile).


15. Changes

DROONE may amend these T&Cs at any time. The version applicable is the one online on the date of the order.

The purpose of this Privacy Policy is to inform users of the dronereclass.com website (hereinafter "the Website") about how the company Droone (hereinafter referred to as "Drone ReCLASS"), in its capacity as data controller, collects, uses and protects their personal data.

Drone ReCLASS only collects data strictly necessary for the following purposes:

  • Order management: name, first name, address, email, telephone number, billing and delivery details, payment information (via Stripe).
  • Execution of the ReCLASS service: proof of installation of the kit, affidavit, serial number of the drone, photo of the original class label.
  • Customer relations and support: exchanges by email or via the contact form.
  • Navigation on the Site: technical data and cookies (see Cookies Policy).
  • Payment data is not stored by Drone ReCLASS: it is processed directly by Stripe, a secure payment operator.


3. Legal basis for processing

The treatments are based on:

  • The execution of a contract (order, delivery, ReCLASS service).
  • Compliance with legal obligations (invoicing, legal guarantees).
  • The legitimate interest of Drone ReCLASS (securing the Site, preventing fraud).
  • User consent (newsletter subscription, non-essential cookies).


4. Purposes of data use

Your personal data is used for:

  • Process and deliver your orders.
  • Issue the certificate of conformity as part of the ReCLASS service.
  • Manage invoicing and administrative follow-up.
  • Respond to your requests via customer support.
  • Comply with our legal obligations (guarantees, accounting).
  • Improve the user experience and security of the Site.


5. Recipients of the data

The data is only accessible to:

  • Drone ReCLASS and its authorized collaborators.
  • Technical and logistics providers (carriers, hosting, management tools).
  • Stripe (secure payment provider).
  • Data is never sold or rented to third parties.


6. Retention period

  • Customer data: kept for the duration of the contractual relationship, then archived for 5 years (legal limitation period).
  • Billing: 10 years (legal obligation).
  • ReCLASS Service: transmitted documents kept for 5 years (proof of conformity).
  • Cookies: maximum duration of 13 months (see Cookies Policy).


7. User Rights

In accordance with the GDPR and the “Informatique et Libertés” law, you have the following rights:

  • Access to your personal data.
  • Rectification of inaccurate or incomplete data.
  • Erasure (right to be forgotten) within legal limits.
  • Objection to or limitation of processing.
  • Portability of your data (transfer).
  • Withdrawal of consent at any time (for processing based on consent).

8. Data security

Drone ReCLASS implements all appropriate technical and organizational measures to guarantee the security and confidentiality of your data (access control, encryption, secure hosting).


Payments are processed exclusively by Stripe, which complies with PCI-DSS security standards.


9. Transfers outside the European Union

In principle, your data is hosted in the European Union. If a transfer outside the EU were to take place (for example via certain technical service providers), Drone ReCLASS undertakes to apply the guarantees provided for by the GDPR (standard contractual clauses, adequacy decisions).


10. Changes to the Policy

Drone ReCLASS reserves the right to modify this Policy at any time. The applicable version is the one online at the time of consultation.
